
So you’re looking to buy a home in Brampton with a separate basement apartment to lease out for extra income, but you have no clues as to the legalities of the basement. What exactly does “Vendor does not warrant retrofit status” mean? What issues do you need to be concerned about when purchasing a home with a basement apartment? Read on, and you shall find out!
What exactly defines a basement apartment?
A basement apartment is a self-contained apartment consisting of a room or rooms in a singe or semi-detached house and can be located in any part of the house, not necessarily in the basement. They have also been called granny flats, nanny suites, accessory apartments and second suites. In the City’s bylaw, they are referred to as a “residential unit”.
A self-contained apartment shall have a separate means of entry (which may be through another unit) a kitchen (or cooking area) and bathroom facilities. A self-contained apartment may be as small as a single room that contains all of the features listed.
However, if you rent a room in a house or a flat with a shared entrance, kitchen and bathroom facilities, this bylaw does not apply to you.
Are basement apartments legal in Brampton?
If you purchase a home in Brampton and the basement apartment was built after November 16, 1995, it is illegal. The only legal basement apartments in Brampton had to have been built prior to that date, and have had to been registered with the city before January 31, 2006 and/or have legal non-conforming status.
A single or semidetached registered home can only have one basement apartment. Homes that have been subdivided into more than two units are strictly prohibited unless the property has been specifically zoned to permit multiple units. It is extremely rare to find a house that has been zoned as a triplex!
What should I be watching out for when I am looking to buy a home with a basement apartment?
Lawyers or real estate agents such as myself can confirm the status of a basement apartment with the city in order to provide you with the right information.
Real Estate Agents are bound by code of conduct guidelines and must fully and fairly disclose all information about a property for sale. Homes with doubtful legal status are typically listed with the caution “Vendor does not warrant retrofit status”, and you may have to seek further legal advice before proceeding with the purchase of a home.
What are the risks of an illegal basement apartment?
- Increased Liability – The onus is on a homeowner to meet established standards for a second suite. If anything should happen, such as a fire, the homeowner would be held liable due to failure to meet requirements.
- Loss of Insurance Coverage – Having a rental unit in your home is a material change to your home. Non-disclosure of this change of use may in fact make your coverage null and void.
- Limited recover of damage – An insurance policy is not responsible for rebuilding costs related to meeting current established standards. Your insurance company is only required to cover the costs of fixing your home back to the state that existed at the time your policy was made prior to any damage.
- Prosecution – If you do not meet City codes it means that you are breaking the law. You run the risk of being charged and can face fines with a maximum penalty of $50,000 and/or a year of imprisonment on each count.
- Financing – Income from an unauthorized basement apartment is generally not considered when qualifying for a mortgage loan.
- Tenants – You are a landlord. You are obliged to maintain your basement apartment in good operating order and you must follow all fire safety laws. Tenants may apply for rent reduction where the unit fails to meet the prescribed municipal health, safety, maintenance and property standards.
- Tenant Insurance – Your homeowner’s policy will not cover property owned by a tenant.
Can I legally convert vacant space in my home into a basement apartment?
NO! The City’s zoning by-law does not permit new basement apartments. If the basement apartment did not exist in your home prior to November 16, 1995, a home in Brampton cannot be legally converted. Furthermore, any home built after 1995 can never have an existing legal basement apartment.
In order to permit a new basement apartment, the Zoning By-law would have to be changed. Changing the Zoning By-law requires the submission of a Zoning Amendment application and fee ($7759.00) to the City’s Planning, Design and Development Department.

This is a really great blog, I would like to Thank you for starting a blog like this and making people informed about such things also a place where we can learn from other people, was looking for something like this since few weeks now.
I am experiencing a similar situation and kind of stressed because of the way things are going.
I just bought my 1st house few months back which was made after 2000, previous occupants had the basement partially finished but no side entrance, they had a counter for kitchen, bedroom, washroom and a small living room with kitchen.(without permit I guess)
My agent told me it can be a good rental unit and he introduced me to a guy who offered me to make door on side and make windows bigger as per some new bylaw of city(he told me there is some new bylaw to have bigger windows after 1st Jan 2010).
I asked this guy that I want everything the legal way and he told me nothing to worry he has seen some houses in my area with side opening (I am not sure if he was lying) and its OK to make one and no need of any permit and if we do need he will sort it out later.
Now I got this notice from city that I have made a door and window without permit and I should get a permit.
Now I after reading all this I am kind of worried what are my options? I talked with city and they told me to get a permit by submitting drawings and filling form, but now I am worried if they ask to inspect inside and if someone complaints about basement.

We put in a side door to our basement–and we did it the ‘legal’ way. We did our own drawings–they’re not that hard but if you don’t know how to do it, look at the college drafting/architecture school for students who can do it cheap (if money is an issue for you).
It’s been 2000 so I’m trying to think about the main issues the inspectors are looking for:
1. Did you dig down deep enough so that the water in the drain doesn’t freeze
2. Are railings to specified width?
3. How far away are stairs to the property line
4. How close are you to gas/line

I received a notice of confirmation of two Legal dwelling units, from Bylaws.
Notice also says” please be advised ,it is recommended that you arrange an inspection of these premises to ensure that it is fire safe and all fire safety requirements are met.more informations regarding inspection bt fire protection consultants or home inspectors can be found on websites”
Now I consulted a home inspector last month and he advised me to add something in the basement.He gave me a certificate ,mentioning that I need to add and correct following such and such things.
My questions are,Do I need to keep this certificate with me or I must send it to Bylaws ??

I’ve got a friend who isn’t Internet savvy and asked my help as he’s renting his Walk-out Basement for more than 2 yrs, with separate entrance, kitchen and washroom – house has been built in late 1970. He received notice from ‘City of Brampton’ to vacate his rental basement, he asked me if he can claim that those people are his family member or any other suggestions.

I believe I read somewhere that a tenant could stop paying rent in an illegal secondary dwelling and there would be no recourse for the landlord.Is that true?
Since cities are not enforcing the bylaw, is it true that one may report a landlord to Revenue Canada for unreported income?

We have signed a deal for ahouse in brampton preferably because they wrote in the MLS listing and have confirmed verbally that the basement is legal and they have all the documents. We had a point in the agreement as well that owner will provide the proff that it is registered with the city of brampton. We have paid him a deposit of $5000 and my closing is on Aug 27th, and I came to know yesterday that that the basement is illegal. Can you tell me what are my options? Can i back fof and break the deal? Can I sue them for providing false information? Please help.

If selling and buying drugs is illegal, then the tenant should also be liable for renting a basement apartment, not just the landlord. If the landlord is fined, then the fine should be shared with the tenant for knowingly renting an illegal basement. Since pleading ignorant will not stop the landlord from getting the fine, it should be the same for the tenant.

I need an advise. I am living in basement apartment in brampton. It been more than one year I am here. I came to know that basement is illegal. I contacted to city hall and they confirmed that this basement is illegal and we will have to evacuate this basement at any time. Since I have paid the last month rent and given my landlored 60 days notice of leaving after knowing that basement is illegale. I didn’t pay November Rent to my landlord as per City Hall basement can be evacuated at any time. Now my landlord has given me the notice of evacuation of basement not paying the november rent although he is still holding last month rent. I keep hearing how basement apartments are illegal in brampton after 1996 however how come there are hundreds advertised in the local newspaper and in a new subdivision there are thousands of apartments in peoples basements ? what is being done about this ?

I’m a landlord with an illegal basement and the tenant that occupie that unit is evil and had an ax to grind and contacted the city when she gave notice and they came by and took pictures while we were away. The irony is that called on us for having an illegal basement, when she was working cash and collecting welfare and not paying rent.
We ignored all requests by the city and went to court. That bought us 6 months time. When we went to court, we got the inspection delayed for at least half a year, which meant we were able to keep renting for that long. The timing was perfect because my new tenant gave me notice on the same month that we were schedule to appear in court. We removed the kitchen (stove, cut the water pipes & electrical wires), which is basically what defines an ‘illegal’ basement. Then we called the inspector, he came in and took more pictures. When we appeared in court, uncontested got fined $300 and put back our basement and have found a good tenant.
The laws regarding illegal basements are outdated for our times and are contradictory. The laws just allow civil servants to have jobs (i.e., inspectors, secretaries who send out notices, court clerk lawyers, etc). If you get a call, play the game like they do. You may have to pay for owning an illegal basement, but it’s all just money. You can make it back by renting your illegal basement out again. With time the laws will change — just call your MP and tell them you want illegal basements made legal, like they did in Toronto. Toronto citizens can now have legal second dwelling units.
I rented my basement twice. For 1 month to a Guyanese girl and for 3 months to a Jamaican boy. This caused me so much stress that I ended up with ulcer and other horrible health problems. If basement rental was legal like in Toronto then I would not have been so anxious as I could have taken matters to court. I think Peel region / Brampton should make basement renting legal as the population is increasing and majority of the people want this. If majority want to rent their basements then the local Govt are facists for not being democratic about it. People also need to earn extra money to pay for mortgage and high property tax. Personally I don’t rent my basement anymore as the local Govt. just want money from residents but does not want to help them in any way.
As of today may be most people haven’t learned that city of Brampton has passed a new by-law quitely that all SIDE Entrances to the basement plus entrances thru garage will be considered illigal as of may 14,2011. we will hear more about it in the coming days. Everyone should email their city counselor to let them know how you feel about it.

I would like to complain aganist my neighbor who has an illegal basement. The reason being is that he has 6 vehicles on his driveway, which causes people to think this is acceptable, but its rediculous, and an environmental detriment, not to mention an eyesore. There are forms that you can download and fill out and then submit it to the “Landlord and Tenant Board of Ontario”. Also seek a lawyer’s help. NEVER rent your basement in Brampton to any Guyanese or Jamaican, I am telling you from my own experience. I only rented for 3 months in total. This is summer so do it quick. Also be nice to the renter and try and get her out. In my opinion “ALL useless” immigrants should be DEPORTED ! Burden to this and any other country.

Hi, i am having same issue as ummi. I have two shits living in my basement. The are one who complaint to city and those are the FFFFF***not moving out. I am so frustrated. If city have told me that i can not rent the basement, they should also do somethings about these tenants (shits) to move out. They should also give them notice to. If the unit is illegal then what the hell they are doing in there. They should go out and find legal stuff (mean time they are doing drugs and they think that is legal in canada). What should i do to move them….i hope they go to hell…….like they are making my life misserable. Make your life easy and do this: Issue your tenants with this Notice form: Form N12 – Notice to Terminate the Tenancy at the End of the Term for Landlord’s or Purchaser’s Own Use. This way they won’t be able to stay longer then their original tenancy term (1 year lease or whatever they signed). If they’ve already extended their lease term then they are on what is called a month to month tenancy agreement which means they will have 60 days to move out. On the form just check the box that says you are going to move into the unit, which is perfectly legal and acceptable as then you can use that space for your own enjoyment. Just don’t rent it again for a while or they COULD come back and prove you lied just to get them out. Thanks Sandy for you advice. Actually orginally i was going to give them notice that i need the space but somehow my lawyer said that is faster way was the drug notice but we were not able to prove. I wish i had taken some pictures before i had given them the drug notice. Long story short then they reported our basement to the city and that is the issue now. I told them that the city is saying that you need to move as soon as possible as i can not rent it any more. They are on welfare they are not working and it seems like they know everything how to go around anything. Would i be able to rent later on even if the city have given the notice that i can not. It is not fare. Sometime people do this because they have bigger mortgages and it helps a little bit. Please advice

Your lawyer is giving you wrong advice. Please go to the Landlord and Tenant board and pick up the info sheets and forms. You can just say you want them out because you need the space for your own use, like your kids want to use it or something. I rented my basement twice. In total for 4 months. Both tenants were liars. You need to know how to get rid of them. I NO LONGER rent my basement. Mostly empty. I use it for my race tracks.
I also rent my basement because I’m single and I wouldn’t be able to pay my mortgage without the rental income so I understand your situation (I don’t live in Brampton though). The whole drug thing is hard to prove so I wouldn’t have even went that route if I were you. I had someone use my basement for a grow-op once so I also know how you feel. You won’t be able to legally rent it in the future if you purchased the home in Brampton and the basement apartment was built after November 16, 1995, because it will be illegal. But keep in mind, lots of people who don’t have such ridiculous by-laws rent apartments in their homes that are not “legal”. Actually it is really hard to have a legal apartment in a home due to by-laws, zoning laws, fire & electrical codes etc. It is almost impossible to meet all the standards out there and most apartments are non-conforming anyway. Doesn’t mean they are not SAFE! So whether you rent it again or not is your choice but be prepared to face the fine the city may impose on you if they decide to go that route. Rent to a friend who will keep their mouth shut. Make sure you screen your tenants better and keep all losers out. They will only bring you down.

This is the injustice of the Landlord and Tenant Board and the city bylaws. Municipal laws will be changing and there will be new legislation soon to allow second dwelling units but in the mean time, you should comply with the city and remove the cooking appliances. As long as you don’t withhold hydro and water, aka, “essential services” the LTB can’t ding you.
Are you a frustrated landlord? I sure as hell am. I just spent the better part of the year evicting a professional tenant and through the worse judicial system in the world “The Ontario Landlord and Tenant Board”. I’m calling all frustrated landlords to support my push to change the laws so that it’s fair for landlords to conduct business in the GTA. I’ve already written a long letter to the LTB to Lilian Ma (who won’t do a FK), and will be sending my letter to my MPP but we as landlords need to band together to change the law. We can’t just keep taking this shit and losing money, sleep and quality of life. The system is so broken that it costs money to be a landlord. Why does BC only take 5 days to evict a tenant while Ontario takes on average 90 days? In my case, 8 months! So if you care about your rights, please email me and sign my petition to change the law. Tell all your landlord friends to contact me. I’m so pissed about this injustice and I can’t sit still anymore. Let the idiots at the LTB know that they are ruining the livelihoods of small landlords (intentionally) by their convoluted and unjust rules, all of which are in favour of the same professional tenants who know the loopholes of their broken system. We work so hard and pay tax and the government give all are tax money to these lazy people so they can go do drugs and have fun. They are young and they can work. I am just loosing my sleep over it. My house was made 40 years ago and in these older home people have legal basement but for some reason the city is saying that our basement is not registered as legal. The basement existed before i bought it and i have not way of proving that it was built in 1995. I just wish city be more considerable. 1. if basement can not be used for usefull purposes, then why basement construction is mandatory for the houses and why it is approved.
2. it is a shear wastage of money to build and then to heat and cool if it is left unfinished and vacant. Why the govt will solicit this when there is so much crisis about genuine and quality housing??
3. some bloggers have suggested that basement tenants bring down quality of the neighbourhood: this is nonsense and inhuman and racial statement. As a canadian whose forefathers have all come from outside virtually with nothing in their wallet, we should be ashamed to make statements like those. Please note that the persons (mostly new immigrants) who lives in a basement apartment today will hopefully have a house with a basement for reciprocity in 3 to 5 years.
4. laws should be equivalent among the cities; Toronto being a world class city allows standard basement construction for independent uses, The second class Peel Region Cities like Mississauga and Brampton should abide by it. There is no reason to brag about expectation of better quality of life in these cities without a non polluting street cars and or subways! so to say.
5. I urge all the homeowners with nocely finished basements to call their MPPs regarding this issue and ask for prohibiting the cities enacting the by-law regarding good usage of the basement by renting. Thanks…Mohammed

Very good points you made. I would be happy to draft a letter with your points and will send it to all those interested to fax/mail to the MPP, the attorney-general’s office, the Toronto Star. The written word will have more impact because it leaves a paper trail and they will have to address the numerous complaints. Oral complaints can be easily forgotten and not documented and as you pointed out, government representatives don’t give a damn.
Ummi, why did it take 8 months? Because the tenant is professional. He knows how to take landlords to the wringers of the court system with delay tactics,& lies. The only place that allows lies to be admissable as evidence is at the Landlord and Tenant Board. And if you’re a tenant, your lies carry more weight and is taken as gospel, but the members/adjudicators have been trained to believe that landlords are big, rich and prey on the tenants.

I don’t really understand how it works. The tenant complaint about our basement just becauase i asked them to move out. I had to pay them $2000 inorder to move out. After these people left i got the basement inpected by the fire people as they request. i had to sign a letter etc. But now i got a letter from bylaw as well. That they need to come and inspect the basement and i need to sign a papers that i won’t rent anymore. When bylaw comes what do they look for….I am just so upset by all this. I can not belive this why don’t city make all the basement legal…….just making people’s life misserable..any suggestions…

we are in brampton. Because city gave us the notice to empty the unit but they were saying that to move the tenant is our job not their’s and if we don’t them within 90 days, they were going to take us to the court. It was really sad as they did not pay the rent too and on top of that i had to paythem $1000 to move out. They were the one who complaint to the city. I wish that god put them through a same situation and frustration that we are going through. So they called fire and by law. So now both have sent us the notice. So was just inquiring that when city bylaw comes to inpect the unit what they usually want people to move out, like stove etc.I don’t know why city of brampton make the basement legal.
hi, to monii we recive notice more then 3 monthes ago,thanks to our tenants!!!!!!the b______.she is still in our basement.so my advise to all landlord out there do not do not give your apartment to rent to any single mother,and people from jameika,africa,because this people are free loders,and the special teenage single mother who pop out a innocent children for collecting money from government,do not use these children as a source of income. these single mother can spend money to expand their boobs and bottems butclaim these kids as a burden.my curse to all these kind of mother that they suffer every single disease on the planet earth has and live as long as earth survive and never die and suffer.
and wehad a hearing in the court ,it is rediculous.we complain and judge asked her about how is she feeling about the complain and what does she think about our claim that our parents wants to move,and if she think that we are lying she can take us to court!!!!!!!!come on??what the heck is this,we have no right as a landlord?the judge did not hear us at all.she ask her that when it is comfortable for her to move out,hello we gave tenant a notice since three months,ago.and the city is more amazing ,tanent just call to city and ask 4 weeks more to stay in our ILLEGLE BASEMENT APARTMENT THE ONE THAT IF WE RENT TO SOMEONE WE HAVE PAY A FINE OF 5000$PLUS JAIL TIME.we pay property taxes,we work hard to buy a house and we do not have any rights and these social (bunch of lazy people) of the government reserve all the rights. and other thing the hearing was only for evacuation only,and if we wants our rent we have to pay city again and file a new claim.at this point i am so angry and disappointed with our system,government.
Hi ummi, I really can feel your pain as we are going through same thing. These F******city people why don’t they wake and take some action against tenant living in the basement. If the tenant want to complaint why the F***they are living in illegal basement they should go and find luzory apartment. Because these beast are fed on government assistance. I wish god punish them a same why what they are putting other people through. i hope they get worms in their body. I can not belive this, we work hard and buy these houses and city people think they own these homes. i’ll prey for you that you get out of this situation soon. I really wish there is commitee that take care of these issue. I think we should write a letter to the City MPP….all basement should be legal. Isn’t there anybody in brampton who can take this concern to MPP’s.
